US Residents Privacy Statement

This US Residents Privacy Statement (the “US Privacy Statement”) is for individuals residing in the US states (also “you”). It supplements the information contained in Ficus Technologies Inc. (also “we”, “us”, and “our”) main Privacy Statement at https://ficustechnologies.com/privacy-statement/ . 

It explains how we collect, use, and disclose your personal information and how to exercise your rights under various applicable privacy laws in the United States, including the California Consumer Protection Act (CCPA), the Colorado Privacy Act (CPA), the Connecticut Act Concerning Personal Data Privacy and Online Monitoring (CDPA), the Utah Consumer Privacy Act (UCPA), the Virginia Consumer Data Protection Act (CTDPA), and other applicable US privacy laws coming into the force (collectively, the “US Privacy Laws”).

All capitalized terms used herein shall be used in the same meaning as outlined in our main Privacy Statement.

1. General Provisions 

We collect information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you (the “Personal Information”).

Information that is (1) publicly accessible from federal, state, or local government records, (2) we have a good faith belief you have made available to the public, (3) deidentified information (which we do not try to reidentify), (4) aggregated information, and (5) other information that is exempt from disclosure under US privacy laws is not considered Personal Information.

Our Website obtains the categories of Personal Information from the following sources:

Directly from you. If You submit questions via e-mail, fill in various contact forms, or subscribe to a newsletter from us, such as first and last name, e-mail address, phone number, date of birth, address, job title and company, education and work history, etc.

Indirectly from you. From observing your interactions on our Website, such as IP address, geographical location, browser/platform type and version, Internet Service Provider, operating system, referral source/exit pages, length of visit, page views, website navigation, and search terms that you use.

We did not disclose any Personal Information within the last twelve (12) months. We do not collect, use, or disclose information that the US Privacy Laws consider sensitive personal information, as well as Personal Information related to a child. We have not sold or shared your Personal Information, as that term is defined in the US Privacy Laws, in the preceding twelve (12) months as well.

2. Use of Personal Information

We use Personal Information to:

• provide and improve your access to the Website;  
• conduct analytics and research; 
• analyze and improve the user experience on the Website; 
• enable you to use the Services and provide them to you;
• send you pertinent communications and emails as necessary (you may unsubscribe or opt-out at any time by changing your email preferences link in our emails);

We keep Personal Information for as long as needed to use it for the purposes set in hereby, and/or for as long as we have your permission to keep it. In any event, we are conducting an annual review to ascertain whether we need to keep your data. Your data will be deleted if we no longer need it.

5. Verification Process

Upon receiving your request, we will need to verify your identity to determine you are the same person with whom we have the information in our system. These verification efforts require us to ask you to provide information so that we can match it with the information you have previously provided us. For instance, depending on the type of request you submit, we may ask you to provide certain information so that we can match the information you provide with the information we already have on file, or we may contact you through a communication method (e.g., phone or email) that you have previously provided to us. We may also use other verification methods as the circumstances dictate.

We will only use the personal information provided in your request to verify your identity or authority to make the request. To the extent possible, we will avoid requesting additional information from you for verification. However, if we cannot verify your identity from the information already maintained by us, we may request that you provide additional information to verify your identity and for security or fraud prevention purposes. We will delete such additional information as soon as we finish verifying you.
